Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CrawlHQ API platform, website, and related services (collectively, the "Service") operated by Zeno Ventures Private Limited and Zeno Ventures LLC (collectively, "CrawlHQ", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Account Registration

To access the API, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your API key and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access to your account.

3. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service in a manner consistent with all applicable laws and regulations, including those of India and any other jurisdiction from which you access the Service.

Permitted uses include:

• Automated collection of publicly available web data for legitimate business purposes
• Building AI applications, data pipelines, and research tools
• Competitive intelligence gathering on publicly accessible information
• Monitoring publicly available web content for changes

4. Prohibited Use

You may not use the Service to:

• Scrape or collect personally identifiable information (PII) without the consent of the individuals concerned or in violation of applicable privacy laws
• Access content from websites that explicitly prohibit automated access in their Terms of Service or robots.txt, unless you have obtained separate permission from the website owner
• Circumvent authentication, security measures, or access controls on any system
• Conduct denial-of-service attacks, generate spam, or otherwise harm third-party systems
• Collect, store, or process data related to minors in violation of applicable child protection laws
• Engage in illegal surveillance, stalking, or harassment
• Violate any applicable law, including the Information Technology Act 2000, GDPR, CCPA, or any other data protection regulation
• Resell, redistribute, or sublicense the Service without our written consent
• Use the Service to build a competing product or service

5. Credits and Payment

Access to the API is provided on a prepaid credit basis. Credits are purchased in advance and deducted as you make API calls. All purchases are final — we do not offer refunds for unused credits except where required by law.

Prices are displayed in Indian Rupees (INR) for domestic transactions processed via Razorpay and in US Dollars (USD) for international transactions processed via Stripe. Applicable taxes (including GST) will be added to purchases where required.

Free credits issued at registration expire 90 days after your last active use of the account. Purchased credits do not expire.

6. API Usage and Rate Limits

You agree to respect the rate limits applicable to your plan. We reserve the right to throttle, suspend, or terminate access for accounts that abuse the Service, generate excessive load, or violate these Terms. Attempts to circumvent rate limits (e.g., by using multiple API keys) are prohibited.

7. Intellectual Property

We retain all intellectual property rights in the Service, including our technology, code, infrastructure, and branding. These Terms do not grant you any rights in our intellectual property beyond the limited licence to use the Service as described herein.

You retain ownership of any data you submit to or obtain from the Service. You are solely responsible for ensuring that your use of that data complies with applicable law.

8. Confidentiality

Your API key is confidential. Do not share it publicly, embed it in client-side code, or commit it to public repositories. We are not liable for any misuse arising from your failure to keep your API key secure.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific result will be achieved.

CrawlHQ is a tool for accessing publicly available web data. We make no representations about the accuracy, legality, or completeness of data returned by the API. You are responsible for evaluating and using that data appropriately.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CrawlHQ and its affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising under these Terms will not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless CrawlHQ and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Unused purchased credits may be refunded at our discretion upon written request within 30 days of termination.

13. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with reasonable notice where practicable. We will not be liable to you for any modification, suspension, or discontinuation of the Service.

14. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

For users outside India, disputes may also be resolved by binding arbitration under the rules of the Indian Council of Arbitration, at your option.
